These terms form an agreement between you (or the business you represent) and SMART DADDY (SMC-PRIVATE) LIMITED (“SMART DADDY”, “we”, “us”) regarding the AsanPOS application for Windows. By installing or using the application, you accept these terms. If you do not accept them, do not install or use the application.

1. Licence

We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use the application on devices you own or control, for your own business purposes. Where you obtained the application from the Microsoft Store, the number of devices and users permitted is also governed by the Microsoft Store Terms of Sale and the Microsoft Standard Application Licence Terms.

This is a licence, not a sale. We retain all rights not expressly granted here.

2. What you may not do

  • Reverse engineer, decompile, or disassemble the application, except where that restriction is prohibited by law.
  • Rent, lease, lend, resell, sublicense, or distribute the application, or offer it as a hosted service to third parties.
  • Remove or obscure any copyright, trademark, or other proprietary notice.
  • Use the application to break the law, or to store or process data you have no right to store or process.
  • Attempt to defeat licensing, security, or access controls in the application.

3. Purchases through the Microsoft Store

The application itself is free. If you buy anything inside it — currently an AsanPOS Cloud subscription — the transaction is between you and Microsoft. Pricing, billing, taxes, renewals, refunds, and cancellation are handled by Microsoft under its own terms, and the price shown is the one for your market. Refund requests should be made to Microsoft, not to us. We never receive or hold your payment details.

4. AsanPOS Cloud subscriptions

AsanPOS Cloud is an optional paid service. We provision a PostgreSQL database for your shop, host it, back it up nightly, and keep your counters in step. The application works without it; a subscription adds synchronising and hosting, and nothing else is gated behind it.

  • There is no free trial. A subscription is charged from the moment you buy it. The application is instead free to use on a single computer with no time limit, so you can evaluate it for as long as you like before subscribing.
  • Subscriptions renew automatically until cancelled, at the interval you chose. Cancel at any time through your Microsoft account; cancellation takes effect at the end of the paid period, and we cannot cancel on your behalf.
  • Counters are attached to the Microsoft account that owns the subscription. Counters signed in to a different Microsoft account are separate customers unless you attach them using the pairing code the application provides. Attaching a counter gives that device full access to your shop’s data, so only approve devices you control.
  • If payment fails, synchronising continues through a short grace period so that a card problem does not stop your business. If it is not resolved, synchronising stops.
  • If the subscription ends, the application keeps working on every one of your computers with all of its data. You lose synchronising between counters, not your records. Your hosted database is retained for 90 days so that resubscribing resumes where you left off, after which it is deleted. Retention and deletion are set out in the Privacy Policy.
  • Fair use. The service is for operating your own shop. You may not resell it, share one subscription across unrelated businesses, use the hosted database as general-purpose storage, or place a load on it that disrupts the service for others.
  • We may suspend or terminate the service for non-payment, for breach of these terms, or where required by law. Except in cases of abuse or legal compulsion, we will give you reasonable notice and an opportunity to export your data.
  • No uptime commitment is given. We aim to keep the service available and to restore it promptly, but unless we have agreed a service level with you in writing, AsanPOS Cloud is provided on the same “as is” and “as available” basis as the application. The application is local-first by design precisely so that an outage on our side does not stop you selling.

5. Your data and your responsibilities

All data you enter remains yours. We claim no ownership of it, and we do not sell it, mine it, or use it to train anything — see our Privacy Policy. Whether we hold a copy depends on whether you subscribe to AsanPOS Cloud.

  • Backups remain your responsibility. If you do not subscribe to AsanPOS Cloud, we hold nothing and cannot restore data lost through device failure, theft, accidental deletion, uninstallation, ransomware, or any other cause. If you do subscribe, our nightly backups exist so that we can recover the service after a failure on our side; they are not a substitute for keeping your own backups, and we do not guarantee that any particular record can be recovered.
  • Keeping your devices, Windows accounts, staff passwords, and Microsoft account secure is your responsibility.
  • You are responsible for the accuracy of the records you enter, and for verifying totals, prices, taxes, and balances that the application calculates before relying on them.

6. Using your own database server

As an alternative to AsanPOS Cloud, synchronisation can connect to a PostgreSQL database that you provide. This option is enabled on request rather than offered on the normal setup path. Where you use it, we do not supply, host, operate, monitor, or back up that server. Its availability, performance, security, cost, and compliance are entirely your responsibility, or that of your hosting provider. We are not liable for any loss, corruption, exposure, or unavailability of data on a server we do not control.

7. Sending on WhatsApp

The application can send invoices, statements, and payment receipts to your customers from your own WhatsApp account, which you link to the application by scanning a QR code. Messages are sent from your number, directly from your computer. We do not operate a messaging service, we do not send anything on your behalf, and no message or document passes through us.

  • This is not an official WhatsApp integration. It connects in the same manner as WhatsApp Web, which WhatsApp’s own terms do not sanction for third-party clients. WhatsApp or Meta may restrict, suspend, or ban an account that uses it. You accept that risk when you link your account, and we are not liable for any loss of access to your WhatsApp account or to the messages in it.
  • The feature may stop working at any time — WhatsApp can change its service without notice. We do not warrant that it will remain available, and we may remove it.
  • You are responsible for how you use it: for holding the customer’s consent to be messaged where the law requires it, for the accuracy of the numbers you send to, and for complying with WhatsApp’s terms and with the marketing, consumer-protection, and data-protection laws that apply to you.
  • The application sends only transactional documents, to customers already in your records, one at a time. It has no bulk-messaging or marketing capability, and you may not attempt to use it as one.

8. Lawful use and record keeping

The application is a general business tool. It is not tax, accounting, or legal advice, and it is not certified as a fiscal or tax-compliant device in any jurisdiction. You are responsible for ensuring that your invoices, receipts, ledgers, and retained records satisfy the tax, accounting, consumer-protection, and data-protection requirements that apply to your business. Where you hold personal data about your customers or staff in the application, you act as the controller of that data and must comply with the applicable laws.

9. Updates and changes

We may release updates that add, change, or remove features. Updates delivered through the Microsoft Store are installed according to your Windows settings. We may also revise these terms; the revised version takes effect when published on this page, and continuing to use the application means you accept it. We may discontinue the application or any feature at any time.

10. Support

Support is provided by email on a reasonable-efforts basis — see the Support page. Unless separately agreed in writing, no specific response time, availability level, or fix commitment is promised.

11. No warranty

The application is provided “as is” and “as available”, without warranty of any kind, whether express, implied, or statutory, including any implied warranty of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the application will be uninterrupted, error-free, or free of defects, or that it will meet your requirements.

Some jurisdictions do not allow the exclusion of certain warranties. Where that is so, the exclusions above apply only to the extent permitted, and you may have rights that these terms cannot limit.

12. Limitation of liability

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or exemplary damages, nor for any loss of profits, revenue, business, goodwill, or data, arising out of or connected with your use of, or inability to use, the application — even if we have been advised that such damages are possible.

Our total aggregate liability arising out of or connected with the application or with AsanPOS Cloud is limited to the greater of the amount you actually paid for the application and for any AsanPOS Cloud subscription in the twelve months before the claim, or USD 50.

Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence, or for fraud.

13. Indemnity

You agree to indemnify and hold us harmless against claims, damages, losses, and reasonable expenses arising from your use of the application in breach of these terms or of applicable law, or from the data you choose to store or process with it.

14. Termination

This licence continues until terminated. It ends automatically if you breach these terms. You may end it at any time by uninstalling the application.

An AsanPOS Cloud subscription is separate from this licence and ends as described in section 4: you cancel it through your Microsoft account, or we suspend or terminate it for non-payment, breach, or where the law requires. Ending a subscription does not end this licence, and does not stop the application working on your computers.

Sections 4, 5, 6, 7, 11, 12, 13, 15, and 16 survive termination.

15. Intellectual property

The application, its name, logo, design, and source code are owned by SMART DADDY (SMC-PRIVATE) LIMITED and protected by copyright and other laws. The AsanPOS name and logo may not be used without our written permission. Third-party components included in the application remain the property of their respective owners and are used under their own licences.

16. Governing law

These terms are governed by the laws of the Islamic Republic of Pakistan, and the courts of Lahore, Pakistan have exclusive jurisdiction over any dispute — without prejudice to any mandatory consumer protections available to you where you live.

17. General

If any provision is found unenforceable, the rest remains in force. Our failure to enforce a provision is not a waiver of it. These terms, together with the Privacy Policy, are the entire agreement between us regarding the application. You may not assign these terms; we may assign them in connection with a merger, acquisition, or sale of assets.
